If you're buying a flat or plot in Noida or Greater Noida, you'll hear two terms again and again: leasehold and transfer memorandum. They sound complicated, but the idea is simple — and understanding it protects you.

Why most Noida property is leasehold

Noida and Greater Noida were developed by state development authorities. Instead of selling land outright, the authorities allot it on long-term lease to builders, societies and individuals. So when you buy a flat in a Noida society, you're buying the flat plus a share of leasehold land.

Leasehold doesn't stop you from owning, selling, renting or mortgaging your home — but transfers go through the authority, and its rules and dues apply.

What is a transfer memorandum (TM)?

When a leasehold property changes hands, the authority issues a transfer memorandum recording the new owner. For a resale flat, the typical sequence is:

  • buyer and seller agree the deal and sign an agreement
  • the sale (sub-lease or transfer) deed is registered at the sub-registrar's office
  • the buyer applies to the authority, which checks dues and issues the TM in the buyer's name

Until the TM is issued, the authority's records still show the previous owner.

What to check before buying

  • the original lease or sub-lease deed and the chain of transfers
  • a no-dues certificate from the authority — unpaid lease rent or other charges can become your problem
  • the occupancy certificate for the building
  • for new projects, UP RERA registration and whether the builder has cleared its dues to the authority

Transfer charges

Authorities usually charge a transfer fee on resale. Ask for the current charges early and agree with the seller who pays them.

The bottom line

Leasehold property in Noida is bought and sold every day. Just make sure the paperwork with the authority is complete, and get your TM issued promptly after registry.
