Stamp duty is one of the biggest one-time costs of buying a home, and it is paid upfront in cash, not through your home loan in most cases. Delhi, Haryana and Uttar Pradesh all charge women buyers less than men, so registering a property in a woman's name, or jointly with her, can save lakhs. But the savings differ a lot between the three states, and there are legal and practical traps if you put a property in someone's name only to save duty. This guide sets out the rates as reported in late 2026, shows what the savings look like, and explains the pitfalls.

This is general information, not legal or tax advice. Stamp duty rates and rules change through state notifications. Confirm the current rate with the state registration portal or your sub-registrar, and speak to a lawyer or CA for your own situation.

First, how stamp duty is calculated

In all three states, stamp duty is charged on the higher of the price in your sale deed and the government's circle rate (called collector rate in Haryana) for that property. So if you buy below the circle rate, you still pay duty on the circle-rate value. Registration fees are charged separately. For a fuller picture of what to ask your builder or seller, see our guide on stamp duty and registration in Delhi NCR.

Delhi

The Delhi government's Revenue Department lists these rates for sale, conveyance and gift deeds:

  • Men: 6% of the deal value or circle rate, whichever is higher.
  • Women: 4%.
  • Registration fee: 1% of the value, plus a ₹100 pasting fee.

The official page does not separately list a joint rate. Most banks and property portals report 5% for joint ownership by a man and a woman. Because this is not on the official page we checked, confirm it with the sub-registrar before you budget for it.

Some areas of Delhi, such as NDMC and Delhi Cantonment areas, are reported to have different rates. If your property is in one of these areas, check the rate specifically.

Haryana (including Gurugram and Faridabad)

Haryana's rates depend on two things: the buyer's gender and whether the property is inside municipal limits (urban) or outside (rural). The rates most widely reported for 2026 are:

  • Urban, men: 7%
  • Urban, women: 5%
  • Urban, joint (man and woman): 6%
  • Rural, men: 5%
  • Rural, women: 3%
  • Rural, joint: 4%

The Tribune quoted Haryana's Chief Minister saying that since 2008 the state has charged 7% (including a 2% development fee) for men and 5% for women in urban areas, and that these rates remained unchanged. A few websites show different numbers, but their tables look inconsistent, so we have gone with the figures that most sources and the state's own statement support. Confirm on the Haryana Jamabandi or e-registration portal for your district.

Registration fee in Haryana is not a flat percentage. It is a slab-based fee that rises with the property value, and news reports say the maximum was raised to ₹50,000 in 2018. Check the current slab with the sub-registrar.

Uttar Pradesh (Noida, Greater Noida, Ghaziabad)

UP's standard stamp duty on a sale deed is commonly reported as 7% of the property value. Women get a 1% concession, but with a value limit.

In July 2025, the UP cabinet raised the limit for this concession from properties worth up to ₹10 lakh to properties worth up to ₹1 crore, according to All India Radio's news service and other reports. Earlier, the maximum saving was ₹10,000; with the new limit, the saving can be up to about ₹1 lakh.

There are three points where sources disagree, so be careful:

  • Is it 6% or 5% for women? Government statements describe a single 1% concession on the standard rate, which would make it 6%. Some property portals say 5%. We believe 6% is the better-supported figure, but check the IGRS UP portal.
  • What happens above ₹1 crore? Most reports say the concession does not apply if the property value is above ₹1 crore, which means a property valued just over the line may lose the whole benefit. Check how your property will be valued at the circle rate.
  • Joint ownership with a man: Reports differ on how the concession applies when a woman co-owns with a man. Ask the sub-registrar how the duty will be split.

Registration fee in UP is widely reported as 1% of the property value. Confirm the current amount on the IGRS UP portal.

What the saving looks like

Here is an illustration for a home valued at ₹80 lakh (at or above the circle rate), using the rates above and counting stamp duty only:

  • Delhi: a man pays ₹4.8 lakh (6%); a woman pays ₹3.2 lakh (4%). Saving: ₹1.6 lakh.
  • Gurugram (urban Haryana): a man pays ₹5.6 lakh (7%); a woman pays ₹4 lakh (5%). Saving: ₹1.6 lakh.
  • Noida (UP): a man pays ₹5.6 lakh (7%); a woman pays ₹4.8 lakh (6%). Saving: ₹80,000.

These are rough numbers to show the scale of the benefit. Your actual cost will also include registration fees and other charges; our list of hidden costs of buying a flat in Delhi NCR covers the rest.

How joint ownership works

When two people buy together, the sale deed names both as owners. A few things to keep clear:

  • Shares should be stated. If the deed does not mention shares, it is generally assumed they are equal. If one person is paying far more, say so in the deed.
  • Joint owner is not the same as co-borrower. A co-owner may or may not be a borrower on the home loan. Banks often require all owners to be co-applicants on the loan.
  • Both signatures for sale. To sell or mortgage the property later, all owners must sign.
  • Inheritance. If one owner dies, their share passes under their will or succession law, not automatically to the other owner. A will avoids disputes.

Pitfalls to avoid

Benami concerns

India's benami law targets property held in one person's name but paid for by someone else. However, it has a recognised exception for property bought in the name of a spouse or child where the money comes from the payer's known sources of income. In plain terms, a husband buying in his wife's name with his own declared income is generally treated differently from putting property in the name of a friend or distant relative. Keep a clear payment trail through bank accounts, and take legal advice before buying in the name of anyone other than a spouse or child.

Income tax clubbing

If one spouse pays for a property registered in the other's name without the other contributing, rental income from that property may be added to the payer's income for tax purposes under the income tax clubbing rules. The duty saving does not change who is taxed on the income. Ask your CA how this applies to you.

Loan eligibility

If the woman owner has little or no income, the bank will look at the other applicant's income. Some lenders offer slightly lower interest rates for women borrowers, but terms vary. Our home loan tips for Delhi NCR explain how lenders assess joint applications.

Who actually pays

The stamp duty saving belongs to the person in whose name the property is registered. If a husband pays the entire cost but the property is only in his wife's name, it legally belongs to her. That is fine if it is what the family intends, but it should be a conscious decision, not just a tax trick.

Selling or transferring later

If you later want to add a name or move the property from one spouse to another, you will usually need a new deed, and fresh stamp duty may apply. Decide the ownership structure at the time of purchase.

Practical steps

  • Decide ownership and shares before you sign the agreement to sell.
  • Check the circle rate for the exact property.
  • Calculate duty on the official state calculator (Delhi Revenue Department, Haryana e-registration, or IGRS UP).
  • Make payments from the bank accounts of the people who will own the property.
  • Keep all receipts and the e-stamp certificate safely.
