Many families from Rudrapur and Udham Singh Nagar now live abroad, and buying a home back home — for parents, for a future return, or as an investment — is a common plan. The rules are clearer than many people think, and most of the process can be handled from overseas.

What NRIs can and can't buy

Under India's foreign exchange rules (FEMA), Non-Resident Indians (NRIs) and Overseas Citizens of India (OCIs) can generally:

  • buy residential and commercial property — houses, flats, villas, plots for building, shops and offices
  • inherit any property, and receive residential or commercial property as a gift from a relative

They cannot buy agricultural land, plantation property or farmhouses (unless it's inherited). This matters around Rudrapur, where a lot of land is agricultural — always confirm the land use of a plot or farmhouse before you commit. Rules can change, so check the current position with your bank or a lawyer.

Paying for the property

Payment must come through normal banking channels — typically from your NRE or NRO account in India, or by inward remittance from abroad. Cash payments aren't allowed for NRIs, and it's sensible to keep every payment traceable anyway.

Home loans for NRIs

Most Indian banks and housing finance companies offer home loans to NRIs, usually needing:

  • passport and visa or OCI card
  • overseas employment contract or business proof, and recent salary slips
  • overseas and Indian bank statements
  • a co-applicant in India in some cases

The EMI is repaid from your NRE or NRO account. Use our EMI calculator to plan your budget.

Buying without travelling: power of attorney

If you can't be in Rudrapur for every step, you can appoint a trusted family member through a specific power of attorney that covers this particular purchase. If it's signed abroad, it must be attested at the Indian embassy or consulate and then registered (adjudicated) in India within the time limit. Keep its scope narrow — only what's needed for this property.

Due diligence from overseas

The checks are the same as for any buyer, and it's worth paying a local lawyer to do them:

  • clear title and chain of sale deeds
  • khatauni and mutation in the seller's name
  • approved map, and RERA registration for projects
  • no loans or disputes on the property

Our document checklist for Rudrapur property covers each one.

Tax basics

As a buyer, you must deduct TDS on many purchases — 1% when you buy from a resident seller and the price is ₹50 lakh or more, and at higher rates when the seller is an NRI. When you later sell as an NRI, your buyer will deduct TDS from the payment. Rental income from your Indian property is taxable in India, and you may need to file returns. Speak to a CA who handles NRI clients.

Looking after the property

A home that stays empty needs care. Consider a gated society, a reliable tenant, or a caretaker, and set up online payment of house tax and electricity bills.
