NRI Guide to Buying Property in Delhi NCR
What NRIs can buy, how to pay, loans, power of attorney and tax basics in Delhi NCR.

Many NRIs from Delhi and the surrounding states buy a home in the NCR — for parents, for an eventual return, or to rent out. Here's what you need to know.
What NRIs can buy
Under India's foreign exchange rules (FEMA), NRIs and OCI card holders can generally buy residential and commercial property — flats, houses, builder floors and plots for building. They can't buy agricultural land, plantations or farmhouses unless inherited.
Paying for the property
Payments must come through normal banking channels — your NRE or NRO account in India or inward remittance from abroad. Keep every payment traceable.
Home loans
Most Indian banks lend to NRIs against salary or business income abroad. You'll typically need your passport and visa or OCI card, employment proof, salary slips and bank statements. EMIs are paid from your NRE or NRO account. Plan with our EMI calculator.
Buying from abroad
You can authorise a trusted relative through a specific power of attorney covering this purchase. If signed abroad, it must be attested at the Indian embassy or consulate and then adjudicated and registered in India within the required time.
Checks to do (or have done)
- RERA registration for new projects — UP RERA or Haryana RERA
- occupancy certificate for completed buildings
- leasehold paperwork in Noida and Greater Noida
- clear title, no loans, no disputes
A local lawyer can do these for you.
Tax basics
As a buyer, you deduct TDS where required. When you later sell as an NRI, the buyer deducts TDS from the payment at the rates that apply to non-residents. Rental income is taxable in India. Speak to a CA who handles NRI clients.
